Making a saleable business

#TenureSolutions has recently helped a couple to add value to their property, both by providing separate saleable title to several cabin sites approved for their property, and giving them an opportunity to create a saleable business as a going concern.

They already operate a successful – and growing – weddings hosting business on their property. There’s a stunning site overlooking a lily-filled lake, with Ozzie sub-tropical bush in the background. They have Council approval for a reception centre, for hosting weddings, and for erecting several cabins, but they have no right to sell these structures separately.

With Tenure Solutions assistance, they now have #SeparateTitle over each of the cabin sites (several already have cabins erected), the weddings celebration site and the receptions centre. So as and when they wish, they can sell the cabins; this may not be for some time. We at #TenureSolutions are especially pleased that we’ve helped them with a saleable business and the infrastructure for it. With SeparateTitle to the celebration site and the reception centre, when they’ve built up the weddings hosting business, they now will be able to sell the business as a going concern. This means the goodwill plus the celebrations site plus the reception centre.

Their hard work in building up the business will be better recognised financially when it can be sold as a fully self-contained business, a going concern. A great solution by Tenure Solutions.

Cash in pocket
Free up some cash from your property

If you are sitting on some land – whether a 50ha rural property or a suburban house block, you may be able to apply Company Title and set aside title to a part of your land for sale. In some circumstances, Company Title has different and more beneficial applications than subdivision title or strata/community title.

So if you are thinking about selling off a portion of your land for a weekender or a granny flat, Tenure Solutions might be able to turn your dream into reality – and put some cash into your bank.

Finance

Finance for company title land sales

At Tenure Solutions, we’ve found that there are several pathways to financing purchase of a unit or a patch of land through Company Title, secured against the shares.

We know for a fact that many of the ‘recognisable name’ banks will write loans with such security, several of the ‘second tier’ banks ditto, and some building societies also. But some bank managers aren’t familiar with this product and need to be reminded to check it out with their Retail Manager.

We also know that a number of Mortgage Brokers have established panels of financiers who accept proposals for loans secured with Company Title. So Company Title is no barrier to borrowing to purchase; and the Brokers with whom we’ve spoken advise that the evaluation criteria applied by financiers are much the same as applied to other residential borrowings, with the possible exception of a lower loan to valuation (LTV) ratio, i.e. a slightly higher deposit.

There are some very ‘friendly and favourable’ interest rates for residential borrowings at the moment and these are likely to continue for some time.

Now might be the ideal time to implement Company Title over your property, knowing that the cost of borrowing to purchase is low.

Company title – speedy and saves money

Company Title is often delivered a lot more quickly and at a significantly lower cost than some other forms of separating out individual areas in a building or property, for separate ownership or sale.

We at Tenure Solutions will be happy to examine your individual situation and requirements, and provide a pathway and quotation to separate titles over units or allotments.

Future flexibility in ‘stitching off’ shares in a company-owned property

Tenure Solutions’ land title model is more flexible so it’s possible, provided all  shareholders agree readily, to create additional exclusive areas which are available for occupation and/or sale.

This means that processes for further adaptation of a site are simple and straight-forward; and faster and at less cost, than re-subdividing or re-configuring a Standard or Building Format Plan.

Tiny housing, shared housing

One part of the future in housing is the shift to tiny and #sharedhousing.

Public demand is shifting, and there’s some exciting developments in design and function in tiny housing. Logic suggests that ownership of tiny houses might be anchored in ownership of a smaller allotment however the current State and Local Government environments don’t seem to be “moving with the times”.

TenureSolutions company-based landtitle model enables smaller exclusive areas to be ‘stitched off’ and made available individually for occupation and/or sale.

Value of your property

From time to time, we’ve compared the #value of a property as-is and the potential value with a number of #SpecifiedAreas divided off within it, there’s a satisfying increase in the value under #CompanyTitle.

Whenever we’ve made this comparison, we’ve asked for the expertise of a local #realestate agent to give us an estimate of the #marketvalue of each #SpecifiedArea, then added these up and compared the total with the agent’s estimate of the value as-is.

You can add considerable potential value to your property by implementing the #TenureSolutions system across it.

Investigate the potential of your rural property

You may not be aware of the potential of your rural-zoned property.

Have you had a chat with your #Council about what you can and cannot do, under the #PlanningScheme? It could be worth your while. Many #ruralproperties might be permitted a #seconddwelling, #touristcabins, eco-tourist facilities, a reception centre, #farmstay, worker’s accommodation, certain types of business.

Whatever you’re permitted under the #PlanningScheme, #TenureSolutions can add short term or long term #value by setting up #SpecifiedAreas around whatever structure you decide on; these can be occupied, or #sold, and they can have improvements including structures, and they can be used as security for #borrowing.

Check this out with a phone call to #TenureSolutions.

Enabling pre-sale of lots

Many people looking to break a piece of land into #SmallerLots want to have a structure that enables pre-sale. Sometimes this is a small area and a few lots, other times it’s larger and involves many lots. The owner would like to have a safe structure that protects everyone’s interests, especially the buyers, while giving them access to some of the money.

There can be hurdles, when the different parties are talking about timing of payments, security and protection.

#TenureSolutions has recently developed a method that meets these needs. A developer has an option over a piece of land and has a DA for 50+ lots. They have agreements with builders to purchase several groupings of these lots, and the builders are willing to pay upfront, which will enable all the civil works to be undertaken. The builders require some security of title; however, registered titles cannot be issued until survey plans are approved by local authorities. Catch 22.

However, #TenureSolutions has a relatively inexpensive, fully enforceable interim structure that enables all of these needs to be met. We create titles, which gives security to the purchasers for their purchase payments while civil works are completed.

On completion of the standard process of #CouncilApproval of survey plans and lodgement of these plans for registration with a government land registry title to each lot will be in the names of the initial purchasers.

The Tenure Solutions structure can be applied to any piece of land; none is too small or too big.

Separate titles within a building

#TenureSolutions has recently completed provision of #Title for four units within a single existing structure on a piece of land zoned Rural in a lovely spot overlooking the Gold Coast. Each unit is approved for letting, and there’s a variety of sizes – 217 m², 92 m², 117 m² and 129 m².

There’s good access and a sizeable recreation area in the common area on the property.

The property includes two stand-alone structures; both of which also have #SeparateTitle. There’s a waste treatment system which services all the units, and the Management Scheme (the legal arrangement between the title holders) provides for its management, maintenance and eventual upgrade.

The owner now plans to sell some units and recoup capital, while continuing to own their residence and other units. There also are additional lots where future sale or development may be possible.

Granny flat
Tenure Solutions FAQ

By applying Company Title, Tenure Solutions has establish separate title to a Granny Flat in situations where Subdivision Title cannot. This means that title can be set up to a Granny Flat that provides exclusive rights to occupancy, can be sold and be security for borrowing.

It also provides a means of protecting the Granny’s financial interests in Granny Flat arrangements. When there’s only informal arrangement between a parent and their adult child or children, mostly the exposures and risks rest with the  parents who put up the money.

In an informal agreement the parent is vulnerable as all property rights reside with the property owner – the children. The equitably to protect the rights of parents is to give them property rights over their part of that property adapted or provided for their use – whether a self-contained apartment within the house, or a stand-alone structure.

A legal solution for many granny flat situations is well established across Australia – Company Title. Company Title is used to protect the interests of all parties.

Recognising the realities of many such granny flat situations and properly structured, Company Title may provide reversion or pre-emptive rights to the children.

Tenure Solutions provides a comprehensive suite of services for use in ‘granny flat’ situations.

Several effective and legal forms of land title

Company Title has been supporting tenure in Australia for a very long time, operating in parallel with other, currently more used, forms of title. Company Title operates under Commonwealth legislation whereas Subdivision and Strata/Community Title operate under the legislation of the state governments.

Tenure Solutions is expert in Company Title as well as other forms of title over land.

Before Strata/Community Title was established by state governments, Company Title was common in providing individual titles in apartment blocks, blocks of flats, office buildings, professional chambers and similar. When Strata/Community Title was introduced, it became the ‘go-to’ for its similarities to a simple land subdivision and familiarity of land professionals with subdivision.

The benefits of Company Title are again being recognized and it’s being widely used again. Accordingly, Tenure Solutions has prepared and offers a Company Title model suitable for the needs of 21st Century landowners.

Tenure Solutions is adept at identifying the best approach to title from amongst the available titling systems. We advise our clients on the most effective approach for their individual wishes and outlook.

Providing for succession

Sometimes issues around succession are problematic for families and cause real difficulties in estates. For several clients, Tenure Solutions has been able to clarify and set out intentions of parents for division of their property between children, thus removing some of the potential problems.

Most of us are aware of instances where a real mess has arisen when a property is left to several children. Sometimes it goes smoothly, things are worked through; however at other times it’s combative and expensive, dividing siblings and causing rifts that may never be resolved.

If you have a  property – a patch of land, farm, block of flats – and you’d like to have your children inherit specific parts but cannot subdivide, get in touch with Tenure Solutions to check out options.

We’ve been able to provide successful, legal, enforceable title solutions to give both parents and children peace of mind about who gets what when the estate passes to the kids.

Tenure Solutions FAQ

Q: My solicitor has never heard about Company Title.

Q: My solicitor advises against Company Title saying it’s over-ridden by the Titles Office.

A: There are two major forms of title to land which ensure that a person purchasing land is able to acquire a secure title to that land, in a process that facilitates timely and effective land dealings for the community – Company Title and Torrens System Title.

In Queensland, Company Title predates Torrens Title as its origins are set in the Registration of Deeds Act which preceded Torrens Title. Both forms of title to land continue in application today; both rely on preparation of instruments and documentation.

Company Title was widely known amongst and used by solicitors and property developers until the 1960s when State Governments brought in strata title, a form of Torrens Title. Strata or Community Title became widely taken up, as its legislation sets out a convenient form of ongoing management – CMS or constitution. Rather than have a solicitor start from scratch to draw up a constitution, the CMS could some costs. As a wider range of land professionals was familiar with the notion of subdivision (Strata Title is a form of subdivision) they inclined to applying Strata Title where previously they might have applied Company Title.

This preference for Torrens Title means that many land professionals today haven’t heard about Company Title or are poorly-informed about it.

During its widespread application, nobody had done what Tenure Solutions has done – prepare an up-to-date comprehensive constitution relevant to the 21st Century, that can readily be customized for each individual. With the work that Tenure Solutions has done, the cost of applying Company Title is now likely to be less than Torrens Title. As it operates under Commonwealth legislation, Company Title can be applied in some situations which are prevented by Torrens Title, which operates under the legislation of the several State Governments.

So if your solicitor advises against Company Title,  please ask them to contact Tenure Solutions or give their name to Tenure Solutions for us to contact them.

Costs and speed
Benefits in cost and speed of completion

Company Title is proving to be quicker to prepare and deliver and to cost less than Subdivision Title or Strata Title. In some situations, the all-up cost of Company Title comes in at one quarter of Subdivision Title and the delivery time – from first day of commissioning to delivery of completed documentation – can be less than seven weeks.

This stacks up very favourably against a sky-high all-up cost  and months and months of bureaucratic processing with other approaches to title for land.

These benefits are on top of Company Title being able to be implemented more effectively in some situations where Subdivision Title or Strata Title is challenging if not impossible..

Better than strata community

The habitual ‘go-to’ of many property professionals has been Strata/Community Title. The need for separate title of apartments, office suites and professional suites in commercial buildings, even berths on a jetty, has existed for a very long time and for most of that time, has been met through Company Title. However, when the notion of subdivision was extended to such ‘shared’ structures, Strata/Community Title seemed easy for property professionals and became the go-to method of titling.

As Strata/Community Title becomes more rigid, more expensive and slower to achieve, the benefits of Company Title are increasingly being recognized. A major benefit of Company Title is that, unlike Strata/Community Title, individual title can be created before physical structures are completed and amendments to the layout can be managed more effectively. There are other wins for Company Title – for instance it enables more streamlined, more effective and lower cost management and administration than Strata/Community Title.

In so many respects, Company Title stacks up very favourably against Strata/Community Title which generally sees sky-high all-up cost and months and months of bureaucratic processing.
